Terms & Conditions of Sale

O'Loughlin Landscaping Supplies

1. General

These Terms & Conditions apply to all sales of goods by O'Loughlin Landscaping Supplies ("the Company") to the customer ("the Customer"). By placing an order, the Customer agrees to be bound by these Terms & Conditions.

2. Orders

All orders are subject to acceptance by the Company. The Company reserves the right to refuse or cancel any order at its discretion.

3. Prices

All prices are quoted in Euro (€) and are exclusive of VAT unless stated otherwise. Prices are subject to change without prior notice. The price applicable will be the price in effect at the time of order confirmation.

4. Payment

Payment terms are strictly as agreed at the time of sale. Unless otherwise stated, payment is due in full prior to delivery or collection. Late payments may result in the suspension of further supply and may incur interest in accordance with applicable legislation.

5. Delivery & Collection

Delivery dates and times are estimates only and are not guaranteed. The Company shall not be liable for any loss or damage arising from delivery delays. Risk in the goods passes to the Customer upon delivery or collection.

6. Title of Goods

Ownership of all goods remains with the Company until payment has been received in full.

7. Returns & Refunds

Returns will only be accepted with prior approval from the Company. Goods must be returned unused, in their original condition, and within a reasonable time. Custom-made or special-order items are non-returnable. Refunds, where applicable, will be issued at the Company's discretion.

8. Claims & Damages

The Customer must inspect goods upon delivery or collection. Any claims for damaged, missing, or incorrect goods must be reported within 48 hours. No claims will be accepted after this period.

9. Use of Materials

The Company accepts no responsibility for the application, installation, or use of supplied materials. It is the Customer's responsibility to ensure goods are suitable for their intended purpose.

10. Limitation of Liability

The Company shall not be liable for any indirect, incidental, or consequential loss or damage arising from the sale or use of goods. Liability shall not exceed the value of the goods supplied.

11. Force Majeure

The Company shall not be liable for failure to perform its obligations due to events beyond its reasonable control, including but not limited to weather conditions, supplier delays, strikes, or acts of God.

12. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.

13. Amendments

The Company reserves the right to amend these Terms & Conditions at any time without prior notice.
